Terms and Conditions Little Maryam

Article 1 – Definitions
In these terms and conditions, the following definitions apply:
• Merchant: HalAll B.V., trading under the name Little Maryam, offering products via the webshop littlemaryam.com.
• Consumer: the natural person who enters into an agreement with Little Maryam and does not act in the exercise of a profession or business.
• Distance contract: any agreement concluded between Little Maryam and the consumer via the webshop, without the parties being physically present together.
• Cooling-off period: the period of 14 days within which the consumer may exercise the right of withdrawal.
• Right of withdrawal: the consumer’s right to dissolve the agreement within the cooling-off period without giving reasons.
• Day: a calendar day.
• Durable medium: any means that enables the consumer or Little Maryam to store information in a way that allows future retrieval and unchanged reproduction.

Article 3 – Applicability
1. These terms and conditions apply to all offers by Little Maryam and to all agreements concluded between Little Maryam and the consumer.
2. Prior to placing an order, the consumer can read and save these terms and conditions via littlemaryam.com.
3. Deviations from or additions to these terms are only valid if agreed in writing.
4. If any provision is found to be invalid or void, the remaining terms shall remain in full force.
Article 4 – The offer
5. All offers are non-binding and may be modified or withdrawn by Little Maryam.
6. We aim to describe our products as accurately as possible, including characteristics, ingredients, allergen information and images.
7. Images are for illustrative purposes only; no rights can be derived from them. Colours may vary due to screen settings.
8. Obvious mistakes or typographical errors are not binding on Little Maryam.
Article 5 – The agreement
9. The agreement is concluded at the moment the consumer accepts the offer and payment has been processed.
10. Little Maryam confirms the order by email. Until confirmation has been received, the consumer may cancel the agreement free of charge.
11. Little Maryam takes appropriate measures to secure electronic data transfer and ensure a safe payment environment.
12. Little Maryam may verify within legal limits whether the consumer can meet their payment obligations. For valid reasons, an order may be refused or subject to additional conditions.
Article 6 – Prices
13. Alle prijzen zijn vermeld in euro's en inclusief BTW, tenzij uitdrukkelijk anders staat aangegeven.
14. Shipping costs are stated separately and are visible at checkout.
15. Little Maryam reserves the right to change prices. Price changes do not affect orders already placed.
Article 7 – Maximum order quantity
16. Due to logistical limitations, the following maximum order quantities apply per order:
• Netherlands and Belgium: maximum 8 trays
• Germany: maximum 8 trays
• France: maximum 8 trays

Article 8 – Delivery and fulfilment
18. We deliver orders to the Netherlands, Belgium, Germany and France. Orders are processed and shipped on working days.
19. Estimated delivery times after dispatch:
• Netherlands and Belgium: 1–2 working days
• Germany and France: 2–3 working days
20. Delivery times are indicative. Little Maryam is not liable for delays caused by the carrier or force majeure. In the event of an expected delay, the consumer will be informed in a timely manner.
21. The risk of damage or loss passes to the consumer at the moment of delivery.
22. We work with recognised carriers. At checkout you can choose from available carriers such as PostNL, DPD and DHL.
Article 9 – Right of withdrawal
23. The consumer has the right to withdraw from the agreement within 14 days of receiving the product, without giving reasons.
24. During the cooling-off period, the consumer must handle the product and its packaging with care. The product may only be unpacked or used to the extent necessary to assess its nature, characteristics and functioning.
25. To exercise the right of withdrawal, the consumer must notify Little Maryam within 14 days of receipt via retour@littlemaryam.com. The model withdrawal form (available for download at littlemaryam.com) may be used for this purpose, but is not required.
Exceptions to the right of withdrawal
26. The right of withdrawal does not apply to:
• Products that cannot be returned for hygiene or food safety reasons once the packaging has been opened
• Perishable products or products with a limited shelf life
Article 10 – Return conditions
27. Returns are only possible if the product, which equals one sales unit = 1 tray, is returned complete, unused, and in its original unopened packaging.
28. Return shipping costs are at the expense of the consumer, unless the product was damaged or incorrectly delivered.
29. Upon receipt and inspection of the return, Little Maryam will refund the purchase amount including the standard outbound shipping costs within 14 days via the same payment method used by the consumer.
30. Perishable products or products with a limited shelf life kunnen niet worden geretourneerd, ongeacht of zij met korting zijn aangeschaft.
31. Return requests outside the statutory 14-day period will not be processed.
Article 11 – Warranty and conformity
32. Little Maryam guarantees that products comply with the agreement, the description on the website, and reasonable expectations of quality and usability.
33. The warranty does not apply to damage caused by misuse, negligence or modification of the product by the consumer.
34. The statutory rights of the consumer remain in force at all times.
Article 12 – Payment
35. Payment is made via the methods offered at checkout, including iDEAL, credit card, Bancontact, PayPal and other methods via Mollie and Shopify Payments.
36. Orders are only dispatched once payment has been completed in full.
37. Incorrect payment details must be reported immediately by the consumer via shop@littlemaryam.com.
Article 13 – Complaints
38. Complaints about the performance of the agreement must be submitted fully and clearly within a reasonable time (maximum 2 months after discovery) to info@littlemaryam.com.
39. Little Maryam will respond to complaints within 14 days. If this is not possible, an indication will be given of the timeframe within which the consumer can expect a response.
40. In the event of a damaged or incorrectly delivered product, the consumer must contact us within 48 hours of receipt with a photo and description of the problem.
Article 14 – Liability
41. Little Maryam is not liable for indirect damage or consequential damage.
42. Little Maryam’s liability is limited to the amount of the relevant order.
43. Our products are suitable for use as stated on the packaging. If in doubt about allergies or food intolerances, always consult a doctor or dietitian.
Article 15 – Personal data
44. Little Maryam processes personal data in accordance with the Privacy Policy, available at https://littlemaryam.com/privacy.
45. Personal data is used solely for processing orders and communication regarding purchases.
Article 16 – Disputes and governing law
46. All agreements between Little Maryam and the consumer are governed exclusively by Dutch law. Even if the consumer resides outside the Netherlands, Dutch law remains applicable. The Vienna Sales Convention (CISG) is expressly excluded.
47. Disputes will be submitted to the competent court in the district of Gelderland, the Netherlands.
48. As a consumer, you also have the right to submit a complaint to the Disputes Committee via www.degeschillencommissie.nl.
Article 17 – Force majeure
49. Little Maryam is entitled to suspend the performance of its obligations for the duration of a force majeure situation.
50. If Little Maryam is permanently or temporarily prevented from performing the agreement due to force majeure, Little Maryam is entitled to terminate the agreement in whole or in part or to suspend its obligations, without any obligation to pay compensation arising as a result.
51. Force majeure means circumstances that prevent the fulfilment of the obligation and cannot be attributed to Little Maryam. These include, but are not limited to: government measures, epidemics, pandemics, extreme weather conditions, illness of staff, strikes, supply chain disruptions, transport problems and fire.
52. Little Maryam will inform the consumer as soon as possible of a force majeure situation affecting delivery.
Article 18 – Additional or deviating provisions
53. Little Maryam is entitled to suspend the performance of its obligations for the duration of a force majeure situation.
54. If Little Maryam is permanently or temporarily prevented from performing the agreement due to force majeure, Little Maryam is entitled to terminate the agreement in whole or in part or to suspend its obligations, without any obligation to pay compensation arising as a result.
55. Force majeure means circumstances that prevent the fulfilment of the obligation and cannot be attributed to Little Maryam. Article 18 – Additional or deviating provisions
61. Additional or deviating provisions are only valid if recorded in writing and may never be to the detriment of the consumer. In such cases, the provision most favourable to the consumer shall apply.
